Terms of Service

These Terms of Service ("Terms") govern your use of the bum.pt website (bum.pt) and the bum.pt software, operated by Berg Studio ("we", "us", "our"), based in Switzerland.

By using our website or software, you agree to these Terms.

1. Definitions

  • Software: the bum.pt application, including Community and Professional editions.
  • Website: the bum.pt marketing website and documentation.
  • License Key: the cryptographically signed key that unlocks Professional features.
  • Customer: any person or entity that purchases a Professional license.

2. License to use the software

bum.pt is distributed under a proprietary source-available license. The full license text is available in the LICENSE file in the repository.

In summary:

  • The Community Edition is free to use for up to 25 monitored items.
  • The Professional Edition requires a valid, paid license key.
  • You may view, study, and modify the source code for your own internal use.
  • You may not remove, disable, or circumvent the license verification, feature gating, or item limits.
  • You may not offer the software to third parties as a hosted service (SaaS) without a commercial agreement.
  • You may not redistribute modified versions that remove license enforcement.

3. Professional license

Professional licenses are sold as annual subscriptions through our payment processor Polar.sh. By purchasing a license, you agree to the following:

  • License keys are non-transferable and tied to the purchasing email address.
  • Each license key is for one deployment (one running instance).
  • License keys are cryptographically signed and verified offline. Tampering with or forging a key is a violation of these Terms.
  • The license is valid for the subscription period. When it expires, the software reverts to Community Edition.
  • You can cancel your subscription anytime via the Polar customer portal. The license remains active until the end of the billing period.

4. Payment and refunds

All payments are processed by Polar.sh, which acts as the Merchant of Record. Polar handles billing, invoicing, tax collection, and refunds on our behalf.

Refund requests are handled on a case-by-case basis. Contact us at support@bum.pt within 14 days of purchase if you are unsatisfied.

5. Acceptable use

You agree not to:

  • Use the software for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or forge license keys
  • Share your license key with third parties or use it on multiple instances
  • Use the software to build a competing product or service
  • Overload, attack, or disrupt our website or services

6. Intellectual property

The bum.pt name, logo, website content, and software are the intellectual property of Berg Studio. The source code is available under the terms of the proprietary license. Open-source dependencies retain their respective licenses.

7. Disclaimer of warranties

The software is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the software will be error-free, uninterrupted, or meet your specific requirements.

You are responsible for your own backups, security, and compliance when self-hosting the software.

8. Limitation of liability

To the maximum extent permitted by Swiss law, Berg Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software or website, including but not limited to loss of data, revenue, or profits.

Our total liability for any claim shall not exceed the amount you paid for the Professional license in the 12 months preceding the claim.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the software or website after changes constitutes acceptance of the new Terms.

For material changes that affect existing customers, we will send a notification to the email address associated with your license.

10. Governing law

These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.
